Bill/Fee payments by you to Dogma Soft Limited may be made through an electronic and automated collection and remittance service (the “Payment Gateway”) . The Payment Gateway service is provided to you in order to facilitate access to view and pay your bills online. 
Dogma Soft Limited makes no representation of any kind, express or implied, as to the operation of the Payment Gateway. You expressly agree that your use of this online payment service is entirely at your own risk. 
Limitation of Liability:- 

1. Dogma Soft Limited has made this service available to you as a matter of convenience. Dogma Soft Limited expressly disclaims any claim or liability arising out of the provision of this service. You agree and acknowledge that you shall be solely responsible for your conduct and that Dogma Soft Limited reserves the right to terminate your rights to use the service immediately. 

2. In no way shall Dogma Soft Limited or its affiliates be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data or other intangible losses arising out of or in connection with the access to, use of, or reliance on the Payment Gateway services. 

3. Dogma Soft Limited and the Payment Service Providers assumes no liability whatsoever for any monetary or other damage suffered by you on account of 

(i) the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Payment Gateway; or 
(ii) any interruption or errors in the operation of the Payment Gateway. 
4. You shall indemnify and hold harmless Dogma Soft Limited and their respective officers, directors, agents, and employees, from any claim or demand, or actions. 

5. You agree, understand and confirm that personal data including without limitation details relating to debit card/credit card transmitted over the Internet is susceptible to misuse, theft and/or fraud and that Dogma Soft Limited has no control over such matters. 

6. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by you, Dogma Soft Limited does not represent or guarantee that the use of the payment gateway will not result in theft and/or unauthorized use of data over the Internet.

7. Dogma Soft Limited, the Payment Service Providers and its affiliates and associates shall not be liable, at any time, for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained at this site. 

Debit/Credit card, Bank Account details 
The debit/credit card details provided by you for use of the Payment Gateway will be correct and accurate and you shall not use a debit/credit card, which is not lawfully owned by you. You further agree and undertake to provide correct and valid debit/credit card details. 

You may pay bills/Fees at Dogma Soft Limited by using a Debit/Credit Card or through using your Online Banking Account. When You initiate a payment transaction and/or issue a online payment Instruction and provide Your Card / Bank details: 

1. You warrant that Your fully and lawfully entitled use such Credit / Debit Card, Bank Account for such transactions 
2. You are responsible to ensure that the Card, Bank Account details provided by You are accurate 
3. You are authorizing the debit to the nominated Card, Bank account for the settlement of bills selected by you along with the applicable Fees. 
4. You are responsible to ensure that sufficient credit is available on your nominated Card, Bank Account at the time of making the payment selected by You inclusive of the applicable Fee. 

Terms and conditions related to e-payment 

1. The following terms and conditions will apply to the user of Dogma Soft Limited’s online payment gateway service offered through the Dogma Soft Limited's website. Please go through the conditions carefully and if acceptable, you may register and transact for e-payment on Dogma Soft Limited's Website. 

2. The records of Dogma Soft Limited and/or the Payment Service Provider, generated by the transactions arising out of the use of the Service, including the time the transaction is recorded shall be conclusive proof of the genuineness and accuracy of the transaction.

3. Any excess amount paid through payment gateway to Dogma Soft Limited, otherwise or in lieu of cancellation (after deducting cancellation charges) will be refunded through cheque.

For Business to Business

Unused Balance Clause :- "Any top-up payment / advance payment which is received from retailers / distributors deposit the advance payment to his retail account for, the retailer / distributor does not use the amount for goods & services and he wants his payment to return in this case after one month of deposit, retailer need to give refund request to us, once we will get refund request from the retailer, the balance amount will be refunded within 15 to 20 working days via same source".

  • Sightseeing: You have a choice of seat in coach sightseeing and private sightseeing tours. Please choose the same carefully. Panoramic tours do not allow you to stop at the site of the attractions. You will have to follow a schedule. Entrances to attractions are not included in city tours unless specified.
  • Airlines: You have a choice of full service and low cost airline options. Low cost airlines do not have all services available on board hence please choose the airlines carefully before booking. However certain airlines do not entertain e-tickets. In such cases you will be issued paper tickets. We are only an intermediary party hence cannot be held responsible for any delay or cancellation of flight or change of route - a decision taken by the airline. You will be subject to all terms and conditions as per the airlines.
  • Holidays: Please refer to inclusions and exclusions carefully before booking. You can customize your holiday completely on our site if our packages do not meet your requirements.

Baggage

You will have to limit yourself as per normal baggage policy of the airlines in the respective class that you have chosen to fly. Any excess baggage that you carry shall remain your responsibility. Any loss of baggage by the airlines or the passenger will be the sole responsibility of the airline and the passenger. Normally economy class 20kgs is permitted however if you are traveling to US/ Canada you are permitted to carry 2 pieces as check in and 1 piece as cabin baggage. You are requested to kindly refer to the baggage rules of the individual airlines as the same gets updated from time to time.

Refund

Dogma Soft Ltd.   reserves the right to determine the amount of refund value in case of cancellation and amendments. The decision on the quantum of refund will be final as that made by Dogma Soft Ltd.The refund will be made in the name of the client. In case you have booked through the Travel Agent or a Franchisee still we will make the refund in the passengers name. It will take at most 15 days to process refunds for all services. There will be no refund for unutilised services unless specified. All cancellation and amendment charges will be applicable as per principles policies on which Dogma Soft Ltd.   has no control and you will be subjected to it.

Governing law

All legal disputes will be settled under the laws of Indian courts subject to laws of Republic of India. In the event of any dispute of whatever nature, arising under this Agreement, such dispute shall be settled through good faith negotiation among the parties. In case such dispute cannot be resolved by negotiation within 30 days such dispute shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act 1996. The decision of the arbitral tribunal shall be final and binding upon the parties. In case of the dispute requiring intervention of courts, courts alone shall have exclusive jurisdiction.

Injunctive relief
