It is the policy of Dogma Soft to avoid litigation whenever possible but the decision whether or not to enter into or maintain litigation shall be the decision of Dogma Soft alone. This obligation shall survive the termination or expiration of this Agreement.
Employment:
User will not, on behalf of himself or any third party, employ, or seek to employ any person employed by or engaged by Dogma Soft and its team around the world, or otherwise directly or indirectly induce such persons to leave their employment or independent contractor position thereat.
Copyright:
Company holds the copyright for all copyrighted and copyrightable materials on the Site / Dogma Soft App, including, without limitation, the Company trademark, logo, design, text, graphics and forms, including the selection and arrangement of such elements. In addition, the entire Site / Dogma Soft App is copyrighted as a collective work under the India and other copyright laws. Company holds the copyright in the materials as well as the collective work. Dogma Business Advisor/Partner Earning and Payment:
Dogma Business Advisor/Partner will receive earnings based on valid, non‐fraudulent, clicks that take place on their Web Sites. These earnings are subject to audit and fraud review and are not final until paid. Payments are based on Dogma Soft App data as defined, accounted, and audited by Dogma Soft App. Payments to Dogma Business Advisor/Partner residing in the Indian Rupees or residing outside of will be made via banking. All accounts will be settled in Indian Rupees and no payments will be issued for any amounts less than RS 500. Any amounts less than these amounts will carry over to the next month. Dogma Business Advisor/Partner are responsible for maintaining the correct contact and payment information associated with their accounts. This must be done online using the Dogma Soft App web site / Dogma Soft App / Dogma Soft App. Returned or cancelled payment bank/service fees due to any error in Dogma Business Advisor/Partner contact or payment information are the Dogma Business Advisor/Partner responsibility, and will be deducted from Dogma Business Advisor/Partner account balance. Any fees incurred by Dogma Business Advisor/Partner as a result of payments, including but not limited to bank fees and PayPal fees, are the sole responsibility of Dogma Business Advisor/Partner.
Breach of Agreement:
User understands and agrees that any breach or threatened breach by User of the non-competition and non-disclosure provisions contained in this Agreement will cause Dogma Soft substantial, irreparable harm which is difficult to measure, and that Dogma Soft therefore may obtain an injunction against such conduct and User consents thereto. This right is in addition to any other rights Dogma Soft may have against User for breach of this Agreement. Therefore, whenever Dogma Soft may apply for restraining order or injunction against User for breaching or threatening to breach this Agreement as described above, User waives any notice to which User may be entitled and consents to such restraining order or injunction. If Dogma Soft proceeds against User in the state court for Rajasthan or the Indian High Courts/ Supreme Court situated in or closest to said area of Jaipur, on any cause of action arising out of this Agreement, User agrees that such court may exercise personal jurisdiction over User. In the event of any breach of this Agreement by User, User agrees to pay Dogma Soft all losses and damages sustained as a result thereof, as well as court costs, attorney fees, and related expenses.
Miscellaneous:
This Agreement contains the entire understanding and agreement between the parties with respect to the terms and conditions of Users independent contractor relationship with Dogma Soft. Dogma Soft reserves the right to make changes to the Site, related policies and agreements, the terms of services and the Privacy Policy at any time without prior notice to the user. Dogma Soft may assign this Agreement to any successor to all or part of its business or to any parent, subsidiary, or affiliated company. User may not assign this Agreement, or any part thereof, without Dogma Softs written consent.
This Agreement shall be governed and interpreted in accordance with the laws of India. If any provision of this Agreement is declared invalid under such laws, the validity of the other provisions shall not be affected thereby and that part shall remain enforced. Furthermore, User agrees to abide by all local, state and national laws where applicable while serving in the capacity of Independent Contractor/ User to Dogma Soft. This Agreement supersedes any prior understanding or agreements between the parties. It shall be the users responsibility to read and understand the terms and conditions of the agreement and privacy policy updated time to time and the Dogma Soft shall not be responsible for any failure therein on the part of the user.
